Terms & Conditions

These Terms & Conditions ("Terms") govern your use of VitalStackFit (the "App") provided by TorqueTrail, owned and operated by Yogesh Rajendra Jadhav. By downloading, accessing, or using the App, you agree to these Terms.

1. Informational Wellness Only

VitalStackFit provides informational wellness trends and insights only. It does not provide medical advice and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

2. Eligibility and Account Use

You must comply with applicable law and Apple's App Store terms when using the App. You are responsible for maintaining your device security and for all use of the App on your device.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use in accordance with these Terms and Apple's platform rules.

4. Apple Health and Data Permissions

The App may read Apple Health data only with your permission. The core app experience is on iPhone, and Apple Watch-derived metrics may be included when available through Apple Health. You can change Health permissions at any time in iOS settings. Use of HealthKit data is limited to app functionality and user-requested sharing.

5. User Inputs and Generated Content

You may add daily check-ins and preferences in the App. If you choose to share generated cards or text, sharing is initiated by you through iOS share sheet destinations you select.

6. Notifications

Weekly trend reminders are provided via local notifications. Notifications are optional and can be changed or disabled at any time.

To improve reminder relevance, the App may also attempt a best-effort background refresh to update reminder text using on-device Health data and app data already available on your device. Background refresh timing and availability are controlled by iOS and are not guaranteed.

7. Subscriptions and Billing

Pro Monthly and Pro Yearly subscriptions are sold via Apple In-App Purchase. Billing, renewals, cancellation, and refunds are managed by Apple under Apple's terms.

8. Prohibited Conduct

• Do not reverse engineer, decompile, or attempt unauthorized access to the App.
• Do not use the App in a way that violates applicable law or infringes others' rights.
• Do not misuse exported content in unlawful or misleading ways.

9. Intellectual Property

The App, including its design, code, branding, and non-user content, is owned by or licensed to us and protected by applicable intellectual property laws.

10. Service Availability and Changes

We may modify, suspend, or discontinue any feature to maintain quality, security, compatibility, or legal compliance.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" to the fullest extent allowed by law, without warranties of any kind, express or implied.

12. Limitation of Liability

To the fullest extent permitted by law, TorqueTrail and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill arising out of or related to your use of the App.

13. Indemnity

You agree to indemnify and hold harmless TorqueTrail from claims, liabilities, damages, and expenses arising from your misuse of the App or violation of these Terms.

14. Governing Law

These Terms are governed by the laws applicable in Nashik, Maharashtra, India, without regard to conflict-of-law principles, except where mandatory local consumer laws apply. Subject to applicable law, courts in Nashik shall have exclusive jurisdiction over disputes arising from or related to these Terms.

15. Changes to Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date.
